On Monday, Supreme Court Chief Justice John Roberts issued a stay order to keep in place the public health order Title 42 which has barred illegal migrants from entering the country since the start of the pandemic.
The Chief Justice issued the temporary hold after 19 states led by Arizona and Louisiana filed an emergency request to postpone the ending of Title 42 as states along the southern border brace for thousands of migrants a day, according to NBC News.
The potential damage that the end of Title 42 will cause has already started to affect border towns across the southwest. El Paso Mayor Oscar Leeser (D) issued a state of emergency on Sunday in preparation for the influx of migrants pouring over the southern border.
Leeser said that he issued the order given that various Border Patrol facilities were overcrowded which led to migrants sleeping on the streets in continually dropping temperatures, according to PBS News Hour.
The temporary hold lasts only 24 hours, however, as the Biden Administration continues to battle in court to end Title 42 and open the southern border to over 7,000 migrants a day.
“Getting rid of Title 42 will recklessly and needlessly endanger more Americans and migrants by exacerbating the catastrophe that is occurring at our southern border,” explained Arizona Attorney General Mark Brnovich. “Unlawful crossings are estimated to surge from 7,000 per day to as many as 18,000.”
In response to the temporary hold by the Chief Justice, the Department of Homeland Security issued the following statement: “As required by the Supreme Court’s administrative stay order, the Title 42 public health order will remain in effect at this time, and individuals who attempt to enter the United States unlawfully will continue to be expelled to Mexico. While this stage of the litigation proceeds, we will continue our preparations to manage the border in a safe, orderly, and humane way when the Title 42 public health order lifts.”
The influx of migrants into the country has been an ever-increasing problem as governors across the country have attempted to make the problem more of a national issue. Earlier this year, Gov. Greg Abbott (R-TX) bused thousands of migrants to cities like Washington, D.C., and New York City in order to draw attention to the crisis on the southern border.
These efforts, however, went unheard by the Biden Administration and the president’s willingness to end Title 42 without having a new policy in place to deal with the influx of migrants showcases his disregard for America’s national borders.
The president and DHS Secretary Alejandro Mayorkas will need to be held responsible for their irresponsible policies on the southern border and Republican legislators in Congress need to make the border their top priority when the new Congress begins on January 3rd.
