Assaulting a police officer during the tragic attack in Washington’s Capitol Building on Monday resulted in a sentence of roughly four years in prison for a Washington resident who pled guilty.
Devlyn Thompson was sentenced to 46 months in prison by U.S. District Judge Royce Lamberth in the District of Columbia for striking an officer with a baton.
Time already spent in prison will be included toward Thompson’s sentence after his guilty plea in August.
On the basis of Thompson’s actions following his participation in the violent mob at the U.S. Capitol, prosecutors had requested a four-year sentence for Thompson, saying in court filing that “48-month sentence would reflect the gravity of Thompson’s actions while also acknowledging his exceptionally early cooperation and admission of guilt.”
It was claimed by Thompson’s attorney that he is autistic and only had a limited knowledge of what was going on on January 6, and therefore he recommended a one-year sentence.
While autism is not and should not be used as a justification for poor conduct, a person’s specific responsibility and level of social awareness should be taken into account when autism is brought up, according to the court filing.
An extinguisher-wielding man from Florida, Robert Palmer, was sentenced to more than five years in jail this past Thursday, the harshest punishment given to any of more than 700 persons accused of participating in the Capitol disturbance.
Only one other defendant who had admitted to attacking a police officer had been punished before Palmer. Last month, a former New Jersey gym owner, Scott Fairlamb, was sentenced to 41 months in jail on charges of racketeering.
A judge also condemned Jacob Chansley to 41 months in jail last month.
