Earlier this week a state court blocked an order by DeSantis banning mask mandates in his state. But in a big win for parental rights, it was just announced this afternoon that DeSantis has won an emergency appeal to get the order reinstated:
DAILY WIRE – Florida Governor Ron DeSantis (R) on Friday scored a legal win in his fight to ban mask mandates for children in schools across the state, instead allowing parents to decide what’s best for their kids.
After the DeSantis administration filed an emergency motion asking an appeals court to reinstate a stay on his order to ban the mandates, the 1st District Court of Appeal in Tallahassee granted the stay Friday.
“1st District Court of Appeals just granted the State of Florida’s request to reinstate the stay — meaning, the rule requiring ALL Florida school districts to protect parents’ rights to make choices about masking kids is BACK in effect!” posted Christina Pushaw, a spokeswoman for Gov. DeSantis.

This is big news because the appellate courts in Florida are second only to the Florida Supreme Court. Now you can be sure the litigants in this case will appeal this emergency ruling to the Supreme Court, but it will hopefully make little difference as the state’s high court is said to have no liberal activist judges, as they all retired in 2019.
But who knows, maybe they’ll have a different opinion. We’ll find out in the coming days, but I really think this looks good for DeSantis.
