A federal judge just handed President Joe Biden a huge defeat and overruled his immigration policies ordering his administration to bring back the Trump-era policy requiring immigrants seeking U.S. asylum to remain in Mexico while their requests are processed.
The ruling by U.S. District Judge Matthew J. Kacsmaryk in Texas was a huge win for border states dealing with the recent migrant surge which has the system on the brink of collapse.
Kacsmaryk ruled the Homeland Security Department “failed to consider several critical factors, including the benefits of the remain in Mexico policy” and so were not following the law when they revoked Trump’s program.
The judge ripped Homeland Security Secretary Alejandro Mayorkas, saying he ignored his own agency’s data when he pulled the plug on Trump’s successful program.
“By ignoring its own previous assessment on the importance of deterring meritless asylum applications without ‘a reasoned analysis for the change,’ defendants acted arbitrarily and capriciously,” Kacsmaryk ruled.
The judge also put Biden on notice saying ending the program “has contributed to the current border surge.”
“ANOTHER VICTORY! We just won our second immigration lawsuit against the Biden Admin! They unlawfully tried to shut down the legal and effective Remain-in-Mexico program, but #Texas and Missouri wouldn’t have it,” Texas Attorney General Ken Paxton said.
“Together we sued, and just handed Biden yet another major loss,” he added.
Missouri Attorney General Eric Schmitt called the ruling a “massive win.”

The policies under President Trump were working. The numbers on those crossing the border compared to last year are substantially different.
